Duty of Members to Report

The Regulated Health Professions Act -subsection 138(1)-sets out, in law, the duty of Registered Psychiatric Nurses (RPNs)  to report unfit, incompetent or unethical practice of another Registered Psychiatric Nurse (RPN). 

If an RPN reasonably believes that another RPN is unfit to practice, incompetent, unethical, or is suffering from a mental or physical disorder or illness that may affect their fitness to practice and continues to practice despite having been counselled not to, must disclose that belief to the Registrar, along with the name of the other RPN and the particulars.

An RPN who discloses this information is not subject to any liability as a result, unless it is determined that the disclosure was made maliciously.

There may be other times when an RPN is concerned about the practice or conduct of another RPN. The first course of action in these cases might be to talk to the other RPN directly or to talk to your employer.

If you are an RPN and would like to discuss the issue or if you are not sure whether an incident should be reported to the College, contact the College’s Registrar or Deputy Registrar.

* Members of the College are Registered Psychiatric Nurses and Graduate Psychiatric Nurses. 

If a Complaint is Filed Against You

You will be informed if a complaint or a mandatory employer report is made about you. You will receive a copy of the complaint and will be asked to respond in writing. 

Do not speak to the complainant about the matter. Do not speak to any potential witnesses about the matter. Trying to influence the complainant or any potential witnesses could be construed as professional misconduct.

The Registrar reviews all complaints and employer reports to determine if they should be referred to the College’s Complaints Investigation Committee.

The Complaints Investigation Committee investigates complaints and, where appropriate, resolves them informally and/or makes other decisions as set out in The Regulated Health Professions Act.

Once a decision is made, you will be informed of the decision in writing. The complainant is also informed of the decision.
